PLEASE READ CAREFULLY BEFORE USING THE SERVICE OR OUR WEBSITE: THESE TERMS CONSTITUTE A LEGALLY BINDING AGREEMENT. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE THE SITE OR SERVICES. This Terms and Condition (“Agreement”) is a legal agreement between you, the individual user (“User”), and Arpacorp for the Arpacorp website and any other succeeding services which this Agreement is attached to or is a part of. Arpacorp’s website and any other succeeding services includes all materials, printed or electronic, furnished together with or in conjunction with the Arpacorp’s website and any other succeeding services and shall include all modifications and versions thereof. Any reference made in this Agreement to Arpacorp shall be deemed to include, its subsidiaries, successors, assignees, affiliates, and any company that controls Arpacorp, directly or indirectly, and any other subsidiary of such controlling company.

Acceptance

Arpacorp, its blog and social media sites (collectively, the “Site”) are owned and operated by Arpacorp and its affiliated companies (collectively, the “Company” “we” “our” or “us”), and provides network services, proprietary software applications, information and other online services including but not limited to RFID applications, SMS integrations, location tracking, Blockchain, Decentralized application development and articles and information regarding the services and related topics (the “Services”) to you subject to the following terms and conditions (the “Terms”). Our Privacy Policy, Acceptable Use Policy and other documents referred to herein are incorporated by reference and are subject to these Terms. Please read these Terms carefully before you access the Site or Services, as these Terms form a binding legal agreement between you and us. By accessing the Site or registering for or using the Services, you agree to these Terms in their entirety.

Your use of the Arpacorp services shall be deemed your acceptance to be bound by all the terms and conditions of this Agreement. If you do not fully agree with all the terms and conditions of this Agreement, please refrain from using or accessing the Arpacorp services.

Grant and Termination of License

All Services are provided on an “as is” and on a “where is” basis. We give no warranty that our Services will be free of defects and faults. All content, articles and information contained on the Site are provided for convenience only. By registering to use our Services you confirm that you will provide accurate and complete registration data, you will inform us of any changes in your registration data in a timely fashion, you are over 18 years of age and are legally capable of entering into binding contracts, and you agree to comply with our Terms as well as all applicable laws and regulations in connection with your use of the Services.

We restrict access to our Site and Services to individuals who have agreed to be bound by these Terms. We have the right to suspend or close any account with us and block your use of our Site and Services, if you have failed to comply with any part of these Terms.

We do not take any responsibility or accept any liability for your use of or the contents of any third-party website viewed using our Services. You are solely responsible for complying with the terms of use of any website you visit using our Services and the contents of such sites are the sole responsibility of the person from which such content originated.

You agree that you are solely responsible for (and that we have no responsibility to you or to any third party for) any content that you create, copy, transmit, display, download or record while using our Services and for the consequences of your actions (including any loss or damage which we may suffer) by doing so.

You are responsible for all use of your security details and your account. You must treat your username and password, and any other security details, as confidential, and not disclose it to any other person. You must also prevent unauthorized access to your account.

Intellectual Property Rights

The Arpacorp’s website and any other succeeding services, any and all of its aspects, parts or components, or any combination or permutation of such aspects, parts and components, are the exclusive intellectual property of Arpacorp and are protected under intellectual property laws and treaties. Generally, User may not exercise any ownership rights over the Arpacorp’s website and any other succeeding services, any and all of its aspects, parts or components, or any combination or permutation of such aspects, parts and components and may not exercise any rights over the same other than as specifically granted by this Agreement. Specifically, User may not use in an unintended manner, copy, distribute, reverse engineer, decompile or try to disassemble or break the service, any and all of its aspects, parts or components, or any combination or permutation of such aspects, parts and components.

Use of Arpacorp’s website and any other succeeding services

User acknowledges and agrees that the license granted herein for the use of the service may include business, commercial or institutional activities or pursuits, if it shall be limited to the use allowed by Arpacorp. User shall not use the Arpacorp’s website and any other succeeding services, or any Arpacorp Services for purposes contrary to law, public policy, customs, and morals.

Restrictions on Use of Arpacorp API

User agrees to comply with all terms and conditions of use that User uses the Arpacorp’s website and any other succeeding services. This includes, but is not limited to, proper registration such as acquisition and use of a username and password. The Arpacorp API may not be used to upload or transmit any items that are illegal, harmful, harassing, defamatory, vulgar, libelous, or otherwise objectionable. User may not use the service to breach or misappropriate any intellectual property rights of a third person or for any illegal activities. All information, both publicly posted and privately transmitted, are the sole responsibility of the person who sends or posts such items. Users are responsible for all information uploaded, posted, transmitted, emailed, or otherwise made available via the service. Arpacorp shall have the right to monitor materials posted and shall have the right to remove any material that in its opinion violates any law or this Agreement. Users remain solely responsible for the content of the materials they have posted in public areas, Internet forums and transmitted in private e-mail or instant messages.

No Unlawful or Prohibited Use

No user can use the Arpacorp’s website and any other succeeding services for any purpose that is unlawful or prohibited by this Agreement. Users may not use the service to: (a) promote or advertise any unlawful or illegal activity or purpose, including any activity that could give rise to criminal or civil liability; (b) infringe on the copyright, patent, trademark, service mark or any other rights of any person or entity; (c) cause harm to minors in any manner; (d) upload, e-mail, post or transmit any material that is unlawful, illegal, obscene, vulgar, defamatory, harassing, threatening, libelous, objectionable racially or otherwise, or invasive of the privacy of another; (d) carry out any unauthorized alteration of any data or information on or supplied by another user of the service; (e) upload, post, e-mail or transmit any junk mail, or any other unauthorized communication, advertisement, or promotion; (f) distribute or transmit any software viruses or other computer code designed to interfere with the functionality of any computer, hardware, software, server, network or other equipment or devices; (g) impersonate or misrepresent any person or entity or the origin of any Download; or (h) collect, store, transmit, exchange or otherwise distribute the personal information of any users.

You may not attempt to gain unauthorized access to any Arpacorp services, or computer systems or networks connected to any Arpacorp services through data mining, hacking, robots, or any other means. You shall not use the service in any manner that could harm, immobilize, overload, or impair any service or interfere with any other party’s use and enjoyment of any Arpacorp service. Arpacorp reserves the right, in its sole discretion, to terminate your access to the Arpacorp network and the related services at any time, with or without cause and without notice.
